Solaris Law have been very active in the first few months of this year with court proceedings regarding personal guarantees that they have purchased from lenders such as Funding Circle, Capital on Tap and YouLend.
Given that they bought over 10,000 debts form Funding Circle alone, a long pause in collections in 2025 because of the High Court action regarding a Funding Circle personal guarantee last year, and their own new ownership, it would not be surprising that they would attempt to use technology to shortcut processes.
There have been some unforeseen consequences in this regard in several areas of their operation, and in particular we have seen a number of cases where claims have been issued personal guarantors at addresses they no longer live at. Whether this is a technical issue or not, it appears to be occurring multiple times.
Since the claims are not responded to, Solaris Law obtain judgement by default for Azzurro Associates, and the unwary guarantor may not even know this until one day they find it on their credit rating, or further enforcement action is taken.
If any lender obtains judgement with respect to a personal guarantee that was served on a correct address, then it is unlikely that we will be able to assist.
